RE: The tariff classification of a hunting mitt-glove from China.

Dear Mr. Riggle:

In your letter dated March 4, 1998, on behalf of Whitewater Outdoors Inc., you requested a tariff classification ruling.

The merchandise at issue, referenced style number 9899R, is constructed with a camouflage fleece knit fabric. The lined half-fingered, full thumb glove features a rectangular palm overlay (4-1/2 inches by 3-1/4 inches) and a thumb overlay made of textured neoprene. Sewn at the base of the fingers on the back of the glove is a lined pullover half-mitten. This portion can be placed over the partially exposed four fingers or folded back and secured when not in use by means of hook and loop fabric tabs. In addition, the item has a 1-3/4 inch wide rib knit cuff and a hook and clasp.

Your submission asserts that the item is designed and will be marketed and sold for hunting. In support of this you provide samples of advertising for camouflaged apparel and similarly modeled camouflaged hand coverings by both your client and others in the hunting trade. The cumulation of features on style 9899R, in conjunction with the evidence presented, indicate a design for use in the sport of hunting.

The applicable subheading for style 9899R will be 6116.93.0800, HTS, which provides for Gloves, mittens and mitts, knitted or crocheted: other: of synthetic fibers: other gloves, mittens and mitts, all the foregoing specially designed for use in sports, including ski and snowmobile gloves, mittens and mitts. The rate of duty will be 4.4 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
